Journal of Health and Life Sciences Law: The Employee Exceptions to the Anti-Kickback and Stark Laws After Tuomey: What's a Physician's Employer to Do?

Cleveland partner Steven A. Eisenberg co-authored an article in the February 2011 issue of the Journal of Health and Life Sciences Law. Titled “The Employee Exceptions to the Anti-Kickback and Stark Laws After Tuomey: What’s a Physician’s Employer to Do?” the article details the growing complexities involved in a health system’s employment of a physician.

The authors discussed the Employee Exceptions to the Anti-Kickback Statute and Stark Law, along with recent governmental and judicial interpretation of the Exceptions that have created uncertainty in their application. They further detailed the impact this uncertainty may have on the future development of new business structures to deliver healthcare.
