Steinwurtzel Comments on EPA Regulation of Lead Shot in Greenwire

Litigation Partner Robert Steinwurtzel commented on a federal court ruling which stated that environmental groups had waited too long to file a complaint alleging that the EPA was required to regulate lead shot and bullets. His quote appeared in Greenwire (“Judge dismisses claim that EPA should ban lead shot”) on September 30, 2011.

According to the article, “Judge Emmet Sullivan of the U.S. District Court for the District of Columbia held that the Center for Biological Diversity and other environmental groups did not file suit within 60 days of [the] U.S. EPA's decision that it did not have the authority to regulate shot and bullets under the Toxic Substances Control Act,” which requires that parties file a complaint in federal court "within 60 days after the ... denial of the petition."

Steinwurtzel, who represents the lead industry in the Litigation Group with Washington, D.C., Partner Michael Snarr, said he was "pleased that the court recognized that the challenge to lead shot and bullets was untimely" and hopeful that "the parties can reach agreement as to the process going forward."
