Brett A. Wall

Mr. Wall practices in the litigation area with an emphasis on complex commercial litigation and class action defense. He has considerable experience in both state and federal courts, as well as in the arbitration and mediation of disputes. Mr. Wall is a member of the firm’s Class Action Defense Team.

Mr. Wall has extensive experience successfully advising and defending FORTUNE 500 companies and financial institutions in individual and class action lawsuits involving insurance, lending, antitrust, UCC, Sarbanes-Oxley and contract issues. He has defended automobile insurance companies in class actions challenging various aspects of the claims-handling process, including the use of non-original equipment parts in preparing estimates and paying claims, the taking of betterment deductions, the payment of interest on settlement amounts, the obtaining of branded titles in total loss situations and the sale and marketing of insurance policies. He has counseled and defended financial institutions in class actions challenging a variety of lending practices, including the recordation of mortgage satisfactions, fees charged in connection with the processing of mortgage documents, the issuance, transfer and presentment of negotiable instruments and the opening and maintenance of drawee and depositary checking accounts. Mr. Wall also has worked closely with major lending institutions to recover and protect funds in complex multimillion-dollar banking transactions and has counseled both large and small corporations on a variety of business matters.

Mr. Wall brings a practical, focused and results-oriented approach to complex commercial litigation. He has been successful on behalf of various clients in defeating motions for class certification and in obtaining affirmances of those decisions on appeal. He has considerable experience in procuring favorable and early dispositions of cases through the effective use of dispositive motions. Mr. Wall also has served as the lead and second chair attorney on several trials and appeals.

While in law school, Mr. Wall was awarded the Donald S. Teller award for the publication that contributed most significantly to The Ohio State Law Journal. He was also awarded the Joseph M. Hatter award for excellence in trial practice and was a member of the National Moot Court Team. During his final year of law school, Mr. Wall served as a judicial extern for the Honorable Justice Evelyn Stratton of the Ohio Supreme Court. Mr. Wall is a member of the American, Ohio and Cleveland Metropolitan Bar Associations and is a member of the firm’s Hiring Committee.
