Law360: Antitrust Deal Keeps W.Va. Newspaper On Shelves

Washington, D.C., partner Lee Simowitz was quoted in the January 20, 2010, Competition Law360 article, "Antitrust Deal Keeps W.Va. Newspaper On Shelves."

According to the article, the U.S. Department of Justice recently reached an antitrust settlement with Daily Gazette Co. and Affiliated Media Inc. that requires the media companies to restructure their joint operating arrangement in West Virginia in order to keep the Charleston Daily Mail newspaper alive. The Justice Department's lawsuit, filed in May 2007, said that the Daily Gazette Co. allegedly had a plan to terminate publication of the Daily Mail and leave the city with a single daily paper.

"We are pleased that the litigation has been resolved through a settlement," said Simowitz, who represents the Daily Gazette Co. Simowitz, who focuses his practice on antitrust, trade regulation, and consumer protection law, added that the company, facing a tough economic environment, now hopes to put its focus on quality journalism.
