David M. Friebus

David Friebus concentrates his practice in complex commercial and employment litigation. Mr. Friebus has represented private and public entities in all aspects of litigation in federal and state courts, including serving as first or second chair in jury and bench trials, arbitrations and other contested hearings. He has extensive experience in disputes concerning breach of contract, discrimination, retaliation, whistleblower, First Amendment and related federal and state laws. Mr. Friebus also has counseled clients on a wide variety of matters, including employment issues, intellectual property and government investigations, and has published on best practices in the area of anti-discrimination policies.

Representative examples of Mr. Friebus’s practice include:

  • Served as lead counsel in jury trial of claims brought against employer for hostile work environment
  • Defended government entity in class action challenging collective bargaining agreements with home healthcare workers
  • First-chaired arbitration over claims brought against employer for workforce-wide reduction in hours
  • Represented educational institution at trial for damages on breach of contract claims brought by former employees
  • Represented private university in investigation by U.S. Department of Justice regarding institutional compliance with ADA

In addition, Mr. Friebus has maintained an active pro bono practice and has represented clients before the U.S. Court of Appeals for the Seventh Circuit and at the certiorari stage before the U.S. Supreme Court.

Following law school, Mr. Friebus served as a staff law clerk to the U.S. Court of Appeals for the Seventh Circuit.
