David R. Funk

David Funk serves as counsel for a number of automobile manufacturers that are subject to state lemon laws, federal warranty laws and consumer protection statutes. Since 2006, Mr. Funk has taken over 1,000 cases to resolution, including more than 700 in Pennsylvania alone. These Pennsylvania matters have required Mr. Funk to appear before state arbitration boards, trial courts and courts of appeal. Mr. Funk directs and supervises local counsel in the other seven states for which he has primary responsibility for consumer litigation for a large domestic automobile manufacturer.

This representation has provided Mr. Funk with extensive knowledge and experience with regard to state lemon laws, federal warranty laws and consumer protection statutes. These cases require Mr. Funk to engage in case evaluation, discovery strategy and preparation, depositions, expert witness preparation and cross-examination, settlement negotiations and trial.

Mr. Funk was responsible for the successful defense of his client on summary judgment arguing that the client, a manufacturer, was not liable under the Unlawful Trade Practice Act for failing to notify plaintiff of recalls associated with the vehicle prior to purchase.

Mr. Funk is a member of the Ohio and Columbus Bar Associations.
