David Jarrett counsels an array of manufacturers in the implementation, management and problem areas of their retail distribution networks. Recently, Mr. Jarrett served as lead outside counsel to a major U.S. equipment manufacturer in developing its new dealer contracts, and he also served as lead outside counsel to another major U.S. equipment manufacturer in creating its dealer distribution network and agreements regarding that company's acquisition of another manufacturer's machinery business.
While Mr. Jarrett strives to develop reasonable solutions to avoid litigation, if an impasse arises he couples his broad knowledge of the specialized laws with his litigation experience to resolve the problem. Mr. Jarrett's experience includes integrating dealer networks acquired through mergers and acquisitions; drafting dealer agreements, policies and procedure manuals; strategic reorganization of assigned dealer territories or entire dealer networks. When complex issues arise that cannot be amicably resolved prior to litigation, Mr. Jarrett routinely appears in various federal and state courts, state regulatory agencies, and arbitration panels on matters involving terminations, add points, relocations, challenges to manufacturer incentive programs, and denials of transfer requests.
Prior to joining Baker Hostetler in 1999, he represented other attorneys in legal malpractice actions. Mr. Jarrett is currently serving his second term on the State Bar Texas Grievance Committee, Panel 4C06, in Houston, Texas. In 2004, Mr. Jarrett was named a "Texas Rising Star" by Law & Politics and the publishers of Texas Monthly Magazine. "Rising Stars" represent the top 2.5% of up-and-coming attorneys who are chosen based on the results of an extensive nomination and polling process conducted throughout Texas by Law & Politics.
