Gilbert P. Brosky
Gil Brosky concentrates his litigation practice primarily on labor, wage and hour and employment litigation areas. He focuses on assisting employers in a wide variety of employment-related matters and devotes a part of his practice to insurance coverage issues.
Mr. Brosky spends a large portion of his time assisting in the representation of clients in matters arising under the federal Fair Labor Standards Act (FLSA) and various state wage and hour laws. These issues have included alleged violations of overtime, meal and rest break requirements, as well as waiting-time penalties associated with payment of wages upon termination. These matters have included numerous class and collective actions, which have ranged from hundreds of putative plaintiffs to several thousand. Mr. Brosky also has experience in ERISA-related matters and has been involved in the successful defense of several clients in class actions alleging unlawful termination of benefits.
Mr. Brosky has assisted in the successful defense of a number of state and federal employment-related litigation matters, including cases at the appellate level and before the Ohio Supreme Court. These matters have involved issues arising under Title VII, the Family Medical Leave Act, the Americans With Disabilities Act, the Age Discrimination in Employment Act and the Employee Retirement Income Security Act. He has defended a number of state and federal employment-related litigation proceedings and matters pending before administrative agencies such as the Equal Employment Opportunity Commission and the Ohio Civil Rights Commission. He also has experience prosecuting and defending unfair labor practice charges before the National Labor Relations Board.
Mr. Brosky counsels clients, including insurance companies, on insurance coverage issues and has assisted in the litigation of insurance coverage disputes involving a variety issues, including environmental/pollution claims, life insurance and employer liability.
