InformationWeek: Google Wins Nevada Copyright Case

Cleveland partner Deborah Wilcox, was quoted in a January 26 InformationWeek article titled, “Google Wins Nevada Copyright Case.”

The article focuses on the recent ruling which favored Google in a copyright case, finding that Google’s copying and caching of a story posted on an author’s website did not violate copyright law and that storage of the material was “fair use” under copyright law.

Google is also facing lawsuits filed by writers and publishers challenging its “library project,” an initiative to scan and store copyrighted library books. According to Wilcox, the Nevada ruling could have a “marginal impact” in favor of Google in the library case. “Since the facts in the two cases are very different, the impact from the latest decision would be small,” Wilcox said. “The fair use question is also at the heart of the library case.”
