Orlando associate Marilyn Moran was quoted in the August 28, 2009, Insurance Law360 article, "Zurich Told It Must Cover Relocation In Oil Spill Case."
According to the article, a federal judge ruled that Zurich American Insurance Co. must pay Orlando-based Mears Transportation Group Inc. $153,000 to cover the temporary relocation of its employees from its headquarters while an oil spill was cleaned up at the site. The judge ruled that the relocation expenses can be considered cleanup costs under Mears' policy and that the policy does not specifically exclude relocation costs from coverage.
According to Moran, one of the Baker Hostetler team representing Mears, "The ruling was very detailed and exhaustive, and so Mears was very gratified that the court undertook such an exhaustive analysis of all the language that was in the insurance policy, and that the court agreed with Mears that its relocation expenses were covered."
