James H. Nye

James Nye is a trial attorney who focuses his law practice on complex commercial litigation. He represents a broad range of clients, from FORTUNE 100 corporations to individual business owners, on matters including contract disputes, business torts, professional liability and product liability. He represents clients in a wide variety of industries, including engineering, construction, energy, healthcare and manufacturing.

Upon graduating from The University of Texas, Mr. Nye began working in the petrochemical industry as a project manager and gained extensive experience managing the design and construction of hydrocarbon processing units, revamps of LPG fractionation trains and the design, construction and operations management of hydrocarbon storage facilities and transportation terminals.

Mr. Nye has successfully litigated in federal and state courts and before arbitration panels, and has served as first or second chair in arbitrations and at trial. Mr. Nye was selected as a “Rising Star” for 2010 by Law & Politics and the publishers of Texas Monthly magazine.

The following is a list of Mr. Nye’s representative matters:

  • Acted as lead counsel in arbitration trial for a manufacturer of power generation equipment in a complex engineering lawsuit involving the installation of controls systems at a production facility in Equatorial Guinea;
  • Acted as lead counsel in arbitration trial for a publicly traded energy company in a lawsuit involving a breach of a purchase and sale agreement;
  • Acted as counsel in arbitration trial for an international engineering company involving damages against a subcontractor on the construction of an ethylene plant, with trial in Houston, Texas, under the AAA;
  • Represented a technology licensing company in multiple lawsuits regarding the application of a licensed process used in the petrochemical industry;
  • Assisted a manufacturer in a $42 million penalty enforcement case brought by the U.S. Department of Justice in federal court in Texas;
  • Representation of one of the largest drilling contractors in matters relating to oil and gas exploration in cases involving downhole failures;
  • Represented pharmacy management company in wrongful death action arising from an alleged prescription error.

During law school, Mr. Nye served as an intern for the Honorable Nancy K. Johnson, United States Magistrate Judge, Southern District of Texas. He was on the championship team for the John R. Brown National Admiralty Moot Court Competition and was awarded Best Brief and Best Speaker of the Championship Round.

  • “Alliances and Tactics Involving Multiple Parties: From No-Deal Deals to Dismissals with Side Agreements,” presented to the University of Houston CLE Litigation and Trial Tactics Conference (2008 and 2009)
  • “Recovering Money for Delays on the Job,” Construction Executive Magazine, October 2009.
  • Mr. Nye frequently speaks on the topic of multiple party litigation for various CLE presentations.

Mr. Nye is a member of the Texas and Houston Bar Associations and the Texas Young Lawyers’ Association.
