Jason E. Starling
Jason Starling is a management-side employment and labor attorney. He litigates on behalf of, and counsels, firm clients in both the public and private sectors in industries such as transportation, utilities, distribution, manufacturing, automotive, medical product sales, healthcare, education and entertainment.
With respect to litigation matters, Mr. Starling has assisted with a variety of employment matters in both state and federal court. Some examples include enforcement of non-competition agreements, defense of employment discrimination lawsuits and defense of wage and hour actions. He also assists employers in responding to charges of discrimination filed with federal, state or local governmental agencies.
In addition to litigation matters, Mr. Starling’s practice includes effective legal counseling to help employers prevent litigation in the first instance and avoid the associated expenses. He advises firm clients on the wide range of legal requirements affecting the employer-employee relationship and the workplace in general. Listed below are some of the laws and particular issues on which Mr. Starling has provided guidance:
- The Fair Labor Standards Act;
- Ohio’s wage and hour statute and wage payment statute;
- The Family and Medical Leave Act;
- The Americans with Disabilities Act;
- The Rehabilitation Act;
- Federal and state drug-testing laws and regulations;
- Federal and state laws on identity theft, data breach, security of personally identifiable information and information security;
- The Worker Adjustment and Retraining Notification Act and comparable state statutes;
- Separation or severance agreements;
- Employment contracts;
- Non-compete, non-solicitation, non-disclosure and/or trade secrets agreements;
- State trade secrets statutes;
- Employee handbooks;
- Workplace policies such as anti-harassment policies and internal complaint policies and procedures;
- Affirmative action policies for employers who receive or apply for federal funding;
- Section 13(c) requirements for public transit authorities who receive or apply for federal grants; and
- The parallel constitutional issues associated with a public employer's workplace.
In the area of traditional labor law, Mr. Starling assists with labor arbitrations resolving the discipline or discharge of a union employee under a labor contract, as well as arbitrations resolving disputes between an employer and a union over labor contract interpretation. Mr. Starling similarly has assisted in labor contract negotiations, defense of unfair labor practice charges and public-sector interest arbitration proceedings.
While in law school, Mr. Starling was a Managing Editor of the Indiana Law Journal and was member of the school’s Mock Trial Team. He was also a finalist in the school’s moot court appellate advocacy and brief-writing competition.
