Jason P. Perdion

Jason Perdion is an environmental lawyer who helps businesses navigate complex environmental and regulatory challenges. Jason works on a broad range of issues, including the environmental aspects of business transactions, defending against enforcement actions and counseling businesses on compliance with regulatory requirements. Jason brings a practical and results-oriented approach to his practice that includes advising clients on plans and procedures to avoid regulatory issues before they arise so that his clients can focus on their primary business objectives without interruption.

Client and Practice Profile

Jason serves as environmental counsel to manufacturers, developers, industrial clients, trade associations and other large organizations throughout the state and country. His practice focuses on environmental law and litigation and he has represented, counseled and advised clients under various state and federal laws, including the Clean Air Act, the Clean Water Act, the Resource Conservation and Recovery Act, the Toxic Substances Control Act and the Comprehensive Environmental Response, Compensation and Liability Act. He also routinely advises clients with respect to remediation matters at contaminated sites and provides advice on the environmental aspects of real estate and business transactions to reduce potential environmental liability.

Prior to entering law school, Jason was employed by the University of Tennessee providing on-site technical support for Air Force Materiel Command, Wright-Patterson Air Force Base, Ohio, where he was able to see first-hand the challenges faced by large organizations and the competing interests that can arise between an organization’s primary mission and compliance with regulatory obligations. He was responsible for providing guidance for the Command’s hazardous waste management program and developing Command-wide standard operating procedures for complying with applicable laws and reducing instances of violation—and he did so in a manner that did not unreasonably interfere with the organization’s primary mission.

Jason’s Specific Experience

Jason has helped his clients in a variety of ways. Some examples include:

  • Represented national solid waste company before the Environmental Review Appeals Commission related to appeals filed by local citizens’ groups and political subdivisions opposing issuance of the company’s expansion permit. The representation involved 18 days of hearing, including complex testimony on scientific, engineering and environmental issues and the subsequent appeal to the state appellate court. The representation resulted in the permit being affirmed at both the trial and appellate court levels.
  • Represented a national solid waste company in state court regarding threatened denials of a solid waste landfill operating license and obtained a temporary restraining order pre-emptively prohibiting the threatened denial which resulted in negotiated settlement.
  • Represented industrial client related to environmental and nuisance claims asserted by neighboring property owners.
  • Represented developer before the Ohio Environmental Protection Agency related to denial of required wetland authorizations necessary for the developer to construct the project. The case involved a hearing that eventually led to a negotiated settlement that eliminated the restrictions and allowed the project to move forward.
  • Represented developer before the Environmental Review Appeals Commission regarding appeals filed by local citizens in an attempt to block development project.
  • Developed and managed environmental aspects of client’s property portfolio associated with acquisition where seller retained environmental liabilities associated with acquired properties.
  • Represented various potentially responsible parties, including large chemical companies and industrial clients in CERCLA lawsuits and pre-lawsuit settlements.
  • Represented various clients regarding the environmental aspects of business transactions, including potential liabilities and the allocation of environmental responsibilities after closing.
