Jessica Captain Novick focuses her practice in the areas of corporate, healthcare and tax law. She has experience in mergers and acquisitions, entity formation and dissolution and the preparation of sophisticated business agreements, including operating, partnership, buy-sell, purchase and sale, joint venture, management, employment, independent contractor and hospital-based and exclusive service agreements.
Jessica has represented several healthcare clients with respect to the acquisition of their practices and ambulatory surgical centers, as well as developed Health Insurance Portability and Accountability Act (HIPAA) compliance plans and physician recruitment agreements. She has a profound knowledge of the complexities of federal and Florida healthcare laws, including HIPAA, Stark Law, Anti-Kickback Statute, Florida’s Patient Self-Referral Act, Florida’s Patient Brokering Statute and Florida’s Anti-Kickback Statute, among others.
Jessica also has handled sophisticated tax controversies with the Internal Revenue Service for individual and corporate clients. These have included negotiating installment agreements with the IRS, preparing requisite IRS forms, requesting abatement of penalties and interest of personal and employment tax liabilities and evaluating liability in connection with the Trust Fund Penalty.
During law school, Jessica interned for the Honorable William M. Hoeverler, United States District Court, Southern District of Florida. She also worked with the IRS as a certified volunteer to prepare tax returns for low income, disabled and elderly persons.
Jessica holds an AV ranking from Martindale-Hubbell and has been named a 2012 “Top Women Lawyer” by Orlando Home & Leisure Magazine. She is a member of the Florida and American Bar Associations and the American Health Lawyers Association.
