John B. Moorhead

John B. Moorhead has more than 30 years of experience in managing, resolving and trying complex civil and white collar criminal matters. His experience includes four, two-month jury trials and extends to substantive areas of antitrust, securities, trusts and estates, false claims, tax, telecommunications, international, insurance regulatory, director and officer liability, First Amendment, class actions and all species of general commercial litigation. He has appeared in federal and state courts throughout the nation, including courts in Arkansas, California, Colorado, Illinois, Minnesota, Mississippi, New York, North Dakota, Ohio, Oklahoma, South Carolina, Texas, Utah and Wyoming.

Mr. Moorhead has been lead counsel in the defense of numerous national and statewide class actions in federal and state courts. He has been responsible for all facets of class action defense, including defeating class certification, achieving substantive dismissals and creatively settling actions with millions of putative class members, as well as dealing with collateral issues of objectors, opt-outs and regulatory agency overlap. He currently deals on an ongoing basis with new class action issues arising under the Class Action Fairness Act.

Mr. Moorhead has served as lead counsel in numerous notable and highly publicized complex white collar criminal prosecutions in the areas of tax fraud, securities fraud, Medicare fraud, bank fraud, HUD fraud and conspiracy. In the recent past he obtained an acquittal of the president of a mortgage company after a two-month jury trial in a complex multidefendant federal conspiracy prosecution alleging a $35 million loss to the government in an alleged  HUD fraud.

Mr. Moorhead has served as lead counsel in notable non-class action civil matters as well, including recently serving as lead counsel in complex litigation involving the largest estate in Colorado history, the resolution of which was the removal of the estate’s personal representatives and the recovery of more than $350 million for the estate, and recently obtaining a jury trial defense verdict in a $100 million federal False Claims Act action.
