John Foster has extensive experience as lead counsel in trials and appeals, as well as state and administrative proceedings. His practice includes emphasis on family and marital law matters and complex construction and commercial litigation. He has substantial experience in the areas of contract claims, tort claims and general civil litigation.
Mr. Foster serves as lead trial counsel in family law or divorce (marital dissolution) proceedings, including proceedings involving the equitable distribution of assets, alimony, child support, child custody or timesharing, paternity actions, the enforceability of prenuptial agreements and other family law and ancillary commercial issues. He serves as chair of the Equitable Distribution Committee for the Family Law Section of the Florida Bar Association for the 2011-2012 Bar Year.
Mr. Foster has been recognized in Florida Trend’s 2010 and 2011 Florida Legal Elite under adoption, marital and family law, named one of “America’s Leading Lawyers for Business” in Chambers USA and one of Orlando’s top lawyers in Orlando Home and Leisure Magazine. He received a Family Law Section Rising Star Award, 2010-2011.
Mr. Foster has served as lead plaintiffs’ counsel and lead defense counsel for clients in a large variety of high-profile claims, including claims arising out of (i) the design and construction of attractions at major theme parks, (ii) the design or construction of hotel and resort projects, (iii) the design and construction of large public projects, including courthouse and school construction, (iv) the defense of numerous sports teams against antitrust and tortious interference claims, (v) the design and fabrication of a replacement fleet of 12 high-capacity monorail trains for a large theme park, (vi) the misappropriation of trade secrets or proprietary information, (vii) trademark infringement claims, (viii) claims involving Florida’s control share acquisition (or anti-takeover) act, and (ix) other high-profile claims.
Mr. Foster has also prosecuted and defended claims alleging fraud in the inducement, securities fraud and breach of contract arising out of the sale and purchase of stock or assets. Moreover, he was lead trial counsel for the receiver of a large home building company ($100 million in sales). Mr. Foster assisted the receiver in preparing a plan for reorganization in the receivership proceedings and he represented the receiver in prosecuting and defending against numerous claims.
Mr. Foster is a member of the American, Florida and Orange County Bar Associations. He is AV-rated by Martindale-Hubbell.
