Kristopher J. Armstrong

Kristopher Armstrong has a varied practice, encompassing employment litigation, employment counseling, and general litigation.

Mr. Armstrong has been involved in litigation at the trial, appellate and state supreme court levels. In addition, he has experience litigating contested issues before administrative agencies including the Equal Employment Opportunity Commission, the Ohio Civil Rights Commission, the civil rights commissions of numerous other states, and the Ohio Motor Vehicle Dealers' Board. He also has experience with all aspects of arbitration, from brief writing to full evidentiary hearings.

In addition, Mr. Armstrong counsels clients regarding compliance with state and federal anti-discrimination laws, wage-and-hour issues, Ohio ethics laws governing public officials and various state laws governing responses to breaches of data privacy.

After beginning his career as a summer associate with Baker Hostetler, Mr. Armstrong spent two years as a judicial law clerk to the Honorable David A. Katz of the United States District Court for the Northern District of Ohio.

During law school, Mr. Armstrong was a Managing Editor of the Ohio State Law Journal. He was the second-place recipient of the Strong Award for Legal Writing and earned CALI Awards for Excellence in Professional Responsibility, Employment Discrimination, Property and Legal Writing. He is a member of the Order of the Coif, the American Bar Association and the Ohio State Bar Association.

Representative Litigation and Other Matters:

  • Mr. Armstrong has experience deposing parties and witnesses and drafting motions, memoranda, and appellate briefs in employment cases pending in state and federal court;
  • Mr. Armstrong was the principal author of a motion for summary judgment in an employment-discrimination and breach-of-contract case involving a physician plaintiff, in which the court granted summary judgment to our client, finding in favor of the employer on every contested issue;
  • Mr. Armstrong drafted a successful post-hearing brief in a contract-interpretation arbitration over entitlement to an extra vacation benefit, which achieved significant payroll cost savings to the client;
  • Mr. Armstrong has presented oral argument to the Ohio Court of Appeals in a consumer dispute on behalf of a major automobile manufacturer, after which the court affirmed the trial court's ruling in favor of the client on the issue of attorneys' fees;
  • Mr. Armstrong has been a part of a team pursuing enforcement of intellectual property rights on the Internet for a popular, interactive children's toy and collectible company;
  • Mr. Armstrong has analyzed issues related to safe harbors and fair use in connection with the uploading of a client's nationally televised, copyrighted material to YouTube;
  • Mr. Armstrong has analyzed issues related to false advertising in the telephone calling card industry;
  • Mr. Armstrong has analyzed the ramifications of a breach in data privacy that potentially exposed confidential employee data, for a company with operations in over a dozen states;
  • Mr. Armstrong has analyzed issues relating to alleged defamation of a client's customer in a case in federal district court.
