Washington, D.C., partner William Bergmann was quoted in the January 22, 2010, Law360 article, "FotoMedia Drops E.W. Scripps From Photo Patent Suit."
According to the article, a U.S. District Court for the Eastern District of Texas on Tuesday dismissed all claims asserted by FotoMedia Technologies LLC against media conglomerate E.W. Scripps Co. with prejudice, and dismissed with prejudice all counterclaims asserted by E.W. Scripps against FotoMedia. Fotomedia had accused E.W. Scripps of patent infringement regarding the operation and development of various web sites. Furthermore, FotoMedia alleged that E.W. Scripps used these sites to sell a product or service in order to generate revenue.
FotoMedia is also in the process of seeking to overturn a re-examination decision that could sink its case involving three patents that cover an online process for uploading and sharing photos. "The re-examination is not going very well for them, and they are attempting to get as many people out of the case without prejudice as they can," said Bergmann, who led the Baker Hostetler legal team which secured the dismissal for E.W. Scripps. The company is glad to be out of the case with prejudice, Bergmann added.
