Marc D. Flink

Marc D. Flink is a litigation partner in Baker Hostetler’s Denver office. He has diverse experience in civil litigation matters, including pre-litigation counseling, complex litigation, class action litigation, motion practice, expert testimony, discovery and court and jury trials. His practice has involved him in cases relating to first amendment issues, employment law, copyright and trademark law, construction litigation, antitrust litigation, litigation relating to the cable television industry, constitutional issues and a wide range of commercial disputes.

In the area of First Amendment, Mr. Flink has represented media clients in defense of defamation and privacy claims, in open records and access to court matters, in defense of subpoenas, and on newsgathering issues. Mr. Flink also has provided counseling in areas of prepublication review.

Mr. Flink, in the area of commercial litigation, has represented clients in a wide range of contract and commercial disputes. With respect to employment litigation, he has represented employers and employees in disputes relating to wrongful discharge, discrimination, retaliation, unfair competition, breach of duty of loyalty, covenants not to compete and trade secrets.

Mr. Flink’s complex litigation experience includes defense of class actions and cases involving antitrust, cable television and constitutional issues. In 1991, Mr. Flink was appointed as a Special Assistant Attorney General to the State of Wyoming to represent the state's interest in defending an attack on the state’s reapportionment plan for the decade of the 1990s.

Mr. Flink has practiced in Ohio, Colorado, Wyoming and California state trial courts, Colorado Court of Appeals, Colorado Supreme Court, federal district courts, including those in Ohio, Colorado, Wyoming, Nevada and California, the Ninth and Tenth Circuit Courts of Appeals, the United States Claims Court and the United States Bankruptcy Courts in Ohio and Colorado.

Mr. Flink began his legal career upon graduation from law school by practicing in Baker Hostetler’s Cleveland office. He moved to Denver in 1982.
