Paul Enockson is a business litigator, focusing on complex commercial disputes. He has significant experience litigating cases in the oil and gas industry, as well as defending ERISA claims. Understanding the individual corporate interests that are at stake for his clients, Paul brings personal attention to each case to develop the best strategy for achieving his clients' goals.

Paul is the Pro Bono Coordinator of the firm's Denver office. A member of the firm’s national Shale team, he is also familiar with current fracking issues facing the industry.

  • Since 2009, has been a member of the BakerHostetler team that serves as Counsel to the SIPA Trustee for the liquidation of Bernard L. Madoff Investment Securities LLC, working on the global investigation of the Ponzi scheme—the largest financial fraud in history—and related litigations seeking recoveries for the Customer Fund.
Oil and Gas
  • Represented override royalty owners in connection with attempt to wash out royalty interest. Negotiated resolution that restored interests.
Commercial Litigation
  • Represented company in contract dispute relating to indemnification claim for alleged undisclosed environmental conditions in connection with sale of industrial factory.
ERISA Litigation
  • Represented former trustee/officer in breach of fiduciary duty class action involving reasonableness of retained shareholder’s compensation. Obtained summary judgment and settled matter on appeal.

  • Defended claims relating to interpretation of operating agreement and charges for salt water disposal.
  • Prosecuted claims against production company concerning alleged breaches of operating agreement for development and production of coal bed methane.
  • Defended False Claims Act claims alleging knowledge of false statements in connection with alleged underpayment of royalties for gas produced from federal leases located near Cortez, Colorado. Case went to trial and defense verdict was obtained.
Commercial Litigation
  • Represented company in contract dispute relating to indemnification claim for alleged undisclosed environmental conditions in connection with sale of industrial factory.
  • Represented client in multimillion-dollar contract dispute relating to fabrication of needle production machine. Matter settled.
  • Defended against allegations of intentional interference with contract claims arising out of purchase of retail installment contracts.
ERISA Litigation
  • Represented former trustee/officer in breach of fiduciary duty class action involving reasonableness of retained shareholder’s compensation. Obtained summary judgment and settled matter on appeal.
  • Represented company founder and trustee in complex class action involving valuation issues relating to the sale of company stock to an ESOP.
  • Represented former trustee in class action involving fiduciary breach claims relating to ESOP plan amendments.

Pro Bono

  • Member of team that worked as cooperating counsel with the American Civil Liberties Union of Colorado in representing the family of a victim in a wrongful death civil rights suit against three state patrol officers. Team negotiated a settlement of more than $1 million that included a commitment by the Colorado State Patrol to make significant changes to its Fourth Amendment training.
