Paul S. Enockson

Paul Enockson has a wide variety of business litigation experience. His practice focuses on complex commercial disputes, as well as the defense of ERISA claims. He has litigated a broad range of cases, including breach of fiduciary duty, complex contract disputes, conservation easement disputes, oil and gas disputes, product liability and qui tam/False Claims Act cases.

Mr. Enockson’s class action defense focuses on ERISA class actions, including fiduciary breach cases. Mr. Enockson also has experience litigating individual benefit claims under ERISA. Some of his notable ERISA cases include:

  • representing former trustee/officer in breach of fiduciary duty class action involving reasonableness of retained shareholder’s compensation
  • represented company founder and trustee in complex class action involving valuation issues relating to the sale of company stock to an ESOP
  • represented former trustee in class action involving fiduciary breach claims relating to ESOP plan amendments
  • represented plan administrator in individual benefit claims involving 401k account

Since 2009, Mr. Enockson has been a member of the Baker Hostetler team that serves as Counsel to the SIPA Trustee for the liquidation of Bernard L. Madoff Investment Securities LLC, working on the global investigation of the Ponzi scheme—the largest financial fraud in history—and related litigations seeking recoveries for the Customer Fund.

Mr. Enockson is currently working on a number of conservation easement cases in Colorado state courts that have been brought pursuant to House Bill 1300. He is knowledgeable about the issues being faced by those who donated conservation easements in the State of Colorado, as well as the issues being faced by the purchasers of these credits.

Mr. Enockson has been recognized as a Colorado “Rising Star” in the area of business litigation. He has received this distinction in 2009, 2010, 2011 and 2012—each year that he has been eligible.

Mr. Enockson is a member of the American, Colorado and Denver Bar Associations. He currently serves as the office Pro Bono Coordinator and is the former Chair of the office’s Community Activism Committee. Recognizing the importance of community involvement, Mr. Enockson is an active member of the Denver Chamber of Commerce’s Health Care Committee. He is also working with a team of lawyers on a significant pro bono civil rights case that is currently pending in the United States District Court for the District of Colorado.
