Paul Enockson has a wide variety of business litigation experience, including siginificant experience litigating cases relating to the oil and gas industry. His practice focuses on complex commercial disputes, as well as the defense of ERISA claims. He has litigated a broad range of cases, including breach of fiduciary duty, complex contract disputes, conservation easement disputes, oil and gas disputes, product liability and qui tam/False Claims Act cases. Paul’s class action defense focuses on ERISA class actions, including fiduciary breach cases, and he also has experience litigating individual benefit claims under ERISA. In addition, Paul has experience in the oil and gas industry and is familiar with the fracking issues facing the industry. He is also a member of the firm’s Shale team.

Since 2009, Paul has been a member of the BakerHostetler team that serves as Counsel to the SIPA Trustee for the liquidation of Bernard L. Madoff Investment Securities LLC, working on the global investigation of the Ponzi scheme—the largest financial fraud in history—and related litigations seeking recoveries for the Customer Fund.

• Represented employer-sponsored plan in action brought by healthcare provider for reimbursement of services
• Representing former trustee/officer in breach of fiduciary duty class action involving reasonableness of retained shareholder’s compensation
• Represented company founder and trustee in complex class action involving valuation issues relating to the sale of company stock to an ESOP
• Represented former trustee in class action involving fiduciary breach claims relating to ESOP plan amendments
• Represented plan administrator in individual benefit claims involving 401(k) account

Oil and Gas

• Represented service providers and E&P companies in breach of contract and royalty disputes
• Working with an early-stage company focused on the treatment of water for use in fracking and other oil and gas operations
• Represented non-party company representative in deposition and trial testimony relating to dispute between well owner and contractor relating to damage to well during repair operations
• Defense of claims relating to interpretation of operating agreement and charges for salt water disposal
• Provided legal counsel and investigation assistance in connection with oil field fatality during drilling operations
• Prosecution of claims against a production company concerning alleged breaches of operating agreement for development and production of coal bed methane
• Defense of False Claims Act claims alleging knowing false statements in connection with alleged underpayment of royalties for gas produced from federal leases located near Cortez, Colorado

Commercial Litigation

• Represented company in contract dispute relating to indemnification claim for alleged undisclosed environmental conditions in connection with sale of industrial factory
• Represented client in multimillion-dollar contract dispute relating to fabrication of needle production machine
• Defense of alleged intentional interference with contract claims arising out of purchase of retail installment contracts
• Defense of alleged breach of licensing agreement involving the production of products for the automotive industry
