Powers to Address Change to Federal Rules of Civil Procedure

New York partner Marc Powers has been invited by the Practicising Law Institute to be the sole presenter for its October 15, 2009, audio webcast, "Expert Reports: Federal Protection for Drafts Coming."

While the Federal Rules of Civil Procedure generally allow in litigation the discovery of drafts of Expert Reports and communications with counsel retaining the expert, this will change next year with the new amendments adopted by an ABA committee looking into the federal rule changes. These amendments are expected to be approved by the United States Supreme Court next Spring and become law in late 2010.

Powers, who has led Baker Hostetler's national Securities Litigation and Regulatory Enforcement practice team since 2004, will addresss the following issues during the webcast:

  • The current rules under Rule 26 for drafts of Expert Reports
  • Considerations of issues involving the attorney-client privilege and work product doctrine
  • Disclosure of communications between the expert and the retaining attorney
  • New proposed Rule 26 for drafts and attorney/expert communications
