Cleveland partner Steve Eisenberg was featured on ReachMD's XM Radio program "American Medical News" on September 15, 2009, discussing new rules for physicians regarding the confidentiality of patient data.
According to the program, doctors must notify patients if their data has been leaked and they must have a plan in place to notify patients in the event of a security breach. "In a general sense," said Eisenberg, "physicians need to be aware of their current policies and practices, with regard to breach and breach notification. The breach notification final rule that was issued at the end of August, really extends certain requirements to business associates. Business associates are third-parties that do things on behalf of doctors—companies that keep medical records for physicians, companies that audit charts, etc."
