Regina L. Griffin

Regina Griffin is a member of Baker Hostetler’s Bankruptcy, Restructuring and Creditors’ Rights and Litigation practices. She is an experienced trial lawyer, and for the past decade has focused her practice in complex commercial litigation arising out of corporate insolvencies, including:

  • the investigation of potential fraudulent schemes involving chapter 7 and chapter 11 corporate debtors;
  • the prosecution and defense of fraudulent conveyance and preference actions involving tens to hundreds of millions of dollars;
  • litigation regarding the validity, priority, avoidance and subordination of secured creditors’ liens;
  • the defense and assertion of claims of all types filed against corporate debtors, including creditor claims arising out of fraud, contractual disputes, shareholder and partner disputes, lender liability, deepening insolvency, breach of fiduciary duty claims and the in pari delicto doctrine; and
  • advising and representing secured creditors regarding motions to dismiss debtors’ insolvency cases and/or to lift the automatic stay.

Prior to joining Baker Hostetler, Ms. Griffin worked for two other prestigious law firms, including Latham & Watkins. She regularly appears in bankruptcy court, federal and state courts, and has also arbitrated several matters before the American Arbitration Association and the ICC International Court of Arbitration.

Ms. Griffin’s present and recent representations include the following:

  • Counsel for the global representation of the Securities Investor Protection Corporation (SIPC) liquidation of Bernard L. Madoff Investment Securities LLC in connection with one of the largest financial frauds in recorded history. Ms. Griffin leads several legal teams in global investigations and litigations in worldwide asset recovery of hedge funds, fund of funds, investment banks, other financial institutions and fiduciaries;
  • A syndicate of financial institutions regarding their rights as secured creditors in connection with the high profile, half billion-dollar bankruptcy of EnCap, a failed remediator of New Jersey Meadowland landfills;
  • The Chapter 11 Trustee of MarketXT Holdings Corp., a former electronic brokerage company, in the successful prosecution of complex fraudulent conveyance claims and dozens of other multifaceted litigations which led to the recovery of more than $75 million in assets and a 90-percent distribution to creditors;
  • The Litigation Trustee of Dictaphone, a former leading language-recognition software company worth nearly $900 million in connection with federal and common law claims assigned to the Litigation Trust which arose out of Dictaphone’s fraudulently induced merger with then-leading Belgian voice recognition and translation company, Lernout & Hespie; and
  • A leading property development and management firm in connection with the insolvency of retailer-tenants in more than a dozen shopping center properties.
