Richard H. Bamberger has practiced in the employee benefits area since the passage of the Employee Retirement Income Security Act of 1974 (ERISA). He handles employee benefits matters for taxable and non-taxable employers, including all aspects of pension and profit-sharing plans, multiple-employer plans, Taft-Hartley collectively bargained plans, nonqualified benefit plan programs, Code Section 403(b) plans, cash-deferred programs, cafeteria programs, voluntary employee beneficiary associations, medical expense reimbursement plans, and reporting and disclosure requirements with respect to such programs.
Mr. Bamberger has been involved in numerous collective bargaining situations involving retirement plan matters, including plant shutdowns and plan terminations. He has counseled clients in benefit plan matters involved in the sale and acquisition of the stock and assets of corporations, and analyzed the issues related to plan terminations resulting in asset reversions to employers. He has experience in designing nonqualified employee benefit plan programs.
Mr. Bamberger also has counseled closely held and publicly traded companies in their employee benefits programs, including matters involving nonqualified benefit programs and various forms of special compensation for senior, highly compensated employees. Additional experience in litigation matters involves employee benefit plan matters and miscellaneous labor and employee discrimination issues. He also represents and counsels a number of closely held corporations regarding general legal issues.
Mr. Bamberger is currently a member of the Employee Benefits Committee of the American Bar Associationand he is a former Chairman of the Midwest Pension and Benefits Conference. Mr. Bamberger holds an AV rating from Martindale-Hubbell, the leading resource for information on the worldwide legal profession.
