Richard M. Knoth

Dick Knoth practices in the areas of complex commercial litigation, unfair business practices and intellectual property law. He has a wealth of trial experience on behalf of national and international companies in both jury and bench cases in federal and state courts throughout the United States. Mr. Knoth has also argued many appellate cases throughout the federal and state courts. Given the breadth of his trial experience, Mr. Knoth and his team are often also called upon to represent companies undergoing governmental investigations in many areas including advertising, trade practices, antitrust and corporate governance.

Mr. Knoth has been retained to provide representation as lead counsel in many significant matters:

• Defend patent claims and pursue third party contribution/indemnity in federal courts involving developing technology in the field of digital satellite transmission.
• Prosecute patent claims relating to micro-film technology and the development of new technologies in health and hygiene markets.
• Pursue trade secret/unfair competition claims in micro-film technology and innovations regarding state of the art processing of health and hygiene products.
• Represent interests in long term shipping disputes concerning trade practices on navigable waters; included pursuing claims and defenses before a jury and successful resolution of third party claims.
• Defense of claims regarding status of energy supply contracts for long term trade agreements including trial and appeal of cases.
• Prosecution of trade secret/unfair competition claims in federal courts concerning attempts to covertly design and engineer pharmaceutical packaging delivery devices.
• Represent interests of parties contesting the constitutionality of Texas motor vehicle dealer restrictions including pursuit and defense of related injunction actions against state agencies in local and federal courts.
• Prosecute trademark/copyright claims for a national retailer, obtaining a verdict which remains one of the most significant recorded in trademark practice.
• Representation of a national retailer in multiple cases in state and federal courts, successfully defending class claims concerning both warranty plans and various alleged deceptive trade practice act claims in state and federal courts.
• Prosecuted the seminal injunction action to prohibit anti-competitive acts on the internet including the first internet injunction against a web content provider.

Significant Appointments

Mr. Knoth was recently appointed and re-appointed by Cuyahoga County, Ohio, Commissioners to position of Director of the Cleveland/Cuyahoga County Port Authority which is responsible for maritime trade, commercial real estate/finance and urban redevelopment, providing guidance on maritime matters and urban development needs.
