Scott C. Holbrook

Scott Holbrook handles his clients’ biggest and most complex cases, both at trial and on appeal. He has substantial experience representing clients in class action, breach of contract, banking, insurance, healthcare and securities litigation matters.

Notable Cases

  • Represented a large hospital client in a two-month jury trial against its major market competitor. Scott and others on the trial team obtained an award of $10 million in damages and attorneys’ fees, in what is believed to be the largest commercial verdict in the county’s history and one of the few times in the nation a non-profit institution has been found liable for a civil RICO violation. Scott and the team successfully defended the verdict on appeal.
  • Defended a major financial institution against an ERISA class action in which the company’s stock fund lost hundreds of millions of dollars over a two-year period. In a decision receiving national attention because of its major implications for the calculation of damages in ERISA “stock drop” cases, Scott and the litigation team obtained a dismissal of the putative class representative’s case for lack of standing, which the Sixth Circuit affirmed on appeal.
  • Represented a major financial institution in a high-stakes insurance coverage lawsuit against one of the world’s largest reinsurance companies. After several years of contentious litigation in multiple jurisdictions, Scott and others on the team obtained a favorable settlement in excess of $275 million shortly before trial.
  • Defended a major insurance company in a consumer class action involving insurance rates. After filing a summary judgment motion with respect to the named plaintiff’s claims, class counsel dismissed the action.
  • Represented a financial institution as lead counsel in nine consolidated actions alleging improper lending practices. Scott negotiated a settlement for the client and avoided substantial defense costs.
  • Ongoing representation as lead counsel for a publicly held company in consumer class actions filed in federal and state court.
  • Defended a major financial institution against a shareholder derivative suit. Scott and others on the team obtained dismissal of the action on demand futility and statute of limitations grounds.
  • Represented a police officer in a pro bono appeal before the Sixth Circuit. Scott defended against the government’s appeal of his client’s sentence of probation.

Scott has on multiple occasions been named an Ohio Super Lawyers “Rising Star” by Law and Politics. Prior to his more than ten years at BakerHostetler, Scott clerked for the Honorable Karen Nelson Moore on the United States Court of Appeals for the Sixth Circuit. In law school, Scott served as an editor of the Virginia Law Review and won the Bracewell & Patterson outstanding appellate advocate award.
