Scott Bogucki’s practice currently involves commercial bankruptcy litigation, focusing on matters related to Baker Hostetler’s role as counsel to the court-appointed SIPA Trustee in the liquidation of Bernard L. Madoff Investment Securities LLC.
Mr. Bogucki is experienced in various aspects of insolvency and reorganization. He has represented official creditors’ committees, individual secured and unsecured creditors, trustees and examiners in out-of-court workouts, bankruptcy cases and post-confirmation matters. He is experienced in cross-border insolvency cases, having been involved in cases in various countries, including Canada, Mexico and the United Kingdom.

Mr. Bogucki has also served as counsel to the court-appointed auditor of Capital One Bank (USA), N.A., in an action commenced by the United States Trustee against Capital One Bank in In re Galley, as well as counsel to the Federal Deposit Insurance Company (FDIC) in its capacity as receiver of Downey Bank in In re Downey Financial Corporation.
Mr. Bogucki is a co-author of the whitepaper, “Update: Recent Amendments to the New York State Disciplinary Rules and the Solicitation of Potential and Actual Creditors’ Committee Members for the Position of Committee Counsel,” which has been used as supplemental material for various bankruptcy-related seminars and presentations.
