Tom Dietrich focuses his practice in the area of IP litigation. He has represented clients in civil matters, including multiple patent infringement cases on the sides of both plaintiff and defense, copyright and trademark infringement actions, litigation over celebrity rights of publicity and their intersection with the First Amendment, trade secret misappropriation, reverse-passing off under the Lanham Act, and cybersquatting. In addition to litigating, Tom has experience drafting IP rights licensing agreements and ensuring DMCA compliance—he has successfully obtained removal of many pirated copies of clients’ copyrighted works from the Internet and worked with ISPs and domain name registrars to take down infringing websites when necessary.
Tom is a former Assistant Attorney General for the State of Wisconsin, where he accrued a 49-1 appellate win record. Before that, he worked as an associate at another large Orange County firm, handling IP and white collar criminal matters, including FCPA compliance and defense.
While in law school, Tom interned with the Civil Division of the U.S. Attorney’s Office for the Southern District of California and the Alameda County District Attorney’s Office, where he appeared in court numerous times and conducted felony preliminary hearings and argued motions to suppress evidence.
Tom is a member of the Orange County Bar Association (Young Lawyers Division), the Intellectual Property Owners Association, and the Surfing Lawyers Association.
