Victor Siber

Victor Siber’s practice involves all aspects of intellectual property law, including asset protection, patents, copyrights, litigation, trade secrets, trademarks and related transactional matters. Mr. Siber’s practice also includes counseling on patent portfolio development and corporate intellectual property transactions involving asset purchases, mergers and acquisitions, financing, joint ventures, licensing and contractual relationships. His in-depth knowledge of the management of intellectual property assets serves his clients to leverage their portfolios so as to optimize their commercial value through strategic actions.

Prior to joining Baker Hostetler, Mr. Siber served as the head of the Intellectual Property Group at Clifford Chance U.S. LLP. Previously, he was Chief Intellectual Property Counsel of IBM Corporation. While at IBM, Mr. Siber headed the world’s largest corporate IP law department. He was responsible for IBM’s entire patent portfolio, contracts and licensing, including developing its intellectual property licensing program which is recognized as a model for other technology companies.

Mr. Siber’s international experience includes a three year assignment with IBM in Japan and four years in Brazil where he established regional law offices for the company. He has served as a U.S. delegate to several WIPO Committee of Experts meetings and was a key player in the deliberations leading up to the European Software Directive and the TRIPS Agreement. He is fluent in both Spanish and Portuguese. Mr. Siber is past President of the International Intellectual Property Society and past Chairman of the U.S. Bar/JPO Liaison Council. He is a member of the American Bar Association (Patent, Trademark and Copyright Section), the American Intellectual Property Law Association, the Licensing Executives Society, the Intellectual Property Owners Association and the Association of Corporate Patent Counsel. He is a frequent lecturer on intellectual property topics.

Throughout the years Mr. Siber’s practice has been all-encompassing across the spectrum of IP. A few exemplary matters are:

  • Negotiated numerous patent license agreements, including major companies in the Aircraft Industry
  • Responsible partner for several patent litigations and a major ICC Arbitration
  • Handled IP issues and due diligence in numerous M&A transactions for major corporations
  • Conducted IP audits and set up IP asset protection programs for several large firms
  • Manages patent and trademark portfolios for clients
  • Set up structures to enable the monetization of IP assets
  • Provide advice on patent infringement evidence and the issuance of patent opinions regarding validity and infringement
  • Responsible IP partner for the acquisition by Lenovo of IBM’s PC business
  • Negotiated settlement of the longest pending patent litigation in the U.S., Ericsson, Inc. v Interdigital Communications Corporation, et. al., U.S. District Court for the Northern District of Texas, Dallas Division
  • Negotiated major outsourcing contracts
  • Sale and purchase of IP assets
  • Employment issues involving trade secrets
  • General IP counseling
