Overview

Amanda Godzinski advises and represents private companies, municipalities and public employers across the spectrum of employment and traditional labor matters. Amanda has defended employers before both federal and state administrative agencies, and in trial courts across the country. Having been involved in all aspects of litigation, she is experienced in managing large-scale discovery, researching and drafting motions and appellate briefs, taking and defending depositions, and negotiating settlements.

  • Regularly provides counsel on the implementation of employment policies, including drafting and revising employee handbooks, Americans with Disabilities Act compliance, wage and hour compliance, discipline, leaves of absence, and terminations.
  • Served as a member of a legal team responsible for defending a putative class action seeking injunctive relief and damages under the Family and Medical Leave Act on behalf of a class of more than 400 employees.

  • Assisted a major rail carrier in defense of numerous employee whistleblower complaints filed under the Federal Railroad Safety Act.
  • Represented a national snack food manufacturer in employment litigation in numerous states. Cases have included claims of disability, national origin and sex discrimination, and workers’ compensation retaliation. Played a significant role in obtaining summary judgment on all counts in two cases with costs levied against the plaintiff, while the other cases were resolved by settlements favorable to the client.
  • Successfully defended a national construction employer in a multimillion-dollar class action lawsuit alleging failure to pay minimum wage, prevailing wages and overtime compensation. The claims were settled for a nominal sum pending appeal of the class certification, significantly reducing the employer’s liability.
  • Managed the closure of an international clothing manufacturer’s Ohio operations, including advising senior management on personnel and union issues, drafting comprehensive separation agreements, providing Worker Adjustment and Retraining Notification Act notices, and responding to an unfair labor practice charge filed with the National Labor Relations Board.
  • Successfully represented national manufacturing companies in multiple UFCW and United Automobile Workers organizing campaigns.
        Regularly conducts labor and employment due diligence in a range of corporate deal structures.
