Overview

Amy Lenz concentrates her practice on consumer and employment class actions, with an emphasis on consumer privacy cases. Amy regularly represents businesses in putative class actions involving federal statutes such as the Video Protection Privacy Act (VPPA), Fair Credit Reporting Act (FCRA), Fair and Accurate Credit Transactions Act (FACTA) and the Telephone Consumer Protection Act (TCPA).

Amy also represents businesses in state court where consumer data is at issue including under the Illinois Biometric Information Privacy Act (BIPA), state Wiretap Acts and other state consumer statutes. Amy provides cost effective solutions and guides clients through the increasingly complex issues they face in a digital world.

  • Drafted numerous pleadings, dispositive motions, discovery motions and discovery requests for healthcare, banking, securities, commercial landlord-tenant and general commercial clients in state and federal courts, administrative tribunals and arbitration.
  • Performed large document review projects using document knowledge and management software.
  • Analyzed law and drafted memoranda on insurance coverage issues related to business interruption coverage, virus exclusions, insurer’s duty to defend and duty to indemnify.
  • Performed direct and cross-examinations in state court, arbitration and administrative hearings.
  • Developed case theories for registered securities firm client in arbitrations before FINRA.
  • Secured a Seventh Circuit win on the briefs for a commercial landlord-tenant dispute involving claims of tortious interference.
  • Negotiated settlements in shareholder and employment termination disputes.
  • Successfully defended a pharmacy benefits manager in an emergency preliminary injunction hearing in arbitration.
  • Argued a motion to compel in federal court on a dispute over the production of documents in a §1984 prisoner civil rights case.
