With a practice comprising both commercial and intellectual property-focused litigation and arbitration, Andres Muñoz represents clients in a range of matters -- from contracts, breach of fiduciary duties and financial fraud, to investigations, trade secrets and patent infringement. He has significant experience advising on resolutions and general legal strategy short of litigation.

Andres' time in the courtroom includes trial and appellate court appearances, and conducting more than a dozen felony jury trials as an Assistant District Attorney. He is a strong advocate, committed to a business-focused approach that offers efficient and effective solutions.

  • Member of the BakerHostetler team working as counsel to the court-appointed Securities Investor Protection Act Trustee in the liquidation of Bernard L. Madoff Investment Securities LLC:
    • Engaged in several bankruptcy adversary proceedings seeking the recovery of transfers stemming from equity derivative transactions, including swaps and other complex structured products.
  • Represented a pharmaceutical company against allegations of trade secret misappropriation relating to one of its signature products.
  • Represented a corporate director/officer in a dispute with his company involving claims of wrongful termination, breach of fiduciary duty and fraud.
  • Represented a major automotive manufacturer in a contract litigation in New York State Supreme Court, which resulted in a favorable summary judgment ruling dismissing all claims against the client. 
  • Member of the team that defended a German automotive parts company in a patent infringement suit in the Eastern District of Pennsylvania, which resulted in a favorable ruling in international arbitration concluding that the client had not infringed the patent of the opposing party. 
  • Obtained a favorable settlement for a drug manufacturer in patent litigation, during which the client had sued a number of generic drug companies for patent infringement.
