Dan McClain counsels public and private clients on employee benefit and executive compensation matters. Since joining BakerHostetler, he has developed experience drafting and amending qualified retirement, savings and welfare plans as well as advising clients regarding the administration and compliance of such plans with the Internal Revenue Code and the Employee Retirement Income Security Act (ERISA). Dan also has developed experience in the areas of labor and employment.

  • Assists employers with a variety of federal and state labor and employment matters, including issues arising under the National Labor Relations Act and ERISA, as well as other state employment-related laws. Assisted in a multimillion-dollar class action claim concerning alleged violations of Title IV of the Social Security Act. Worked with the Ohio Attorney General's Office, assisted in research and drafted the motion to dismiss, which was granted.
  • Assists employers in transactional matters involving business mergers, acquisitions and divestitures by performing diligence and drafting diligence memorandums regarding employee benefit plans, executive compensation arrangements and potential ERISA matters. Assisted in a merger for a greeting card company by performing due diligence and drafting disclosure schedules.
