Beth Howe counsels clients during litigation matters, concentrating on white collar criminal defense, bankruptcy avoidance and general commercial litigation. She is adaptive when working with clients, distills complicated facts and legal implications into key issues in order to provide clients with direct and applicable advice, and takes complete ownership of her matters.

  • Represented a Russian client in an action under a federal statute in the Southern District of New York seeking discovery from domestic parties in aid of proceedings brought by the client to investigate an alleged kickback scheme by one of the client's employees. Drafted all case pleadings and performed and supervised research for the district court proceeding, and continued these roles during intervening parties' expedited appeal to the Second Circuit Court of Appeals.
  • Assisted in the drafting of a post-conviction petition filed in the Northern District of Illinois challenging the propriety of a client's conviction in an alleged perquisites scheme. The petition alleged that the client's Sixth Amendment right to representation by the counsel of his choice had been violated in the course of his criminal prosecution. The action was ultimately dismissed on procedural grounds arising prior to BakerHostetler's appearance in the proceedings.

  • During a recent expedited trial in the Eastern District of New York, was part of the trial team that successfully defended against breach of contract claims related to the sale of specialized electronic equipment. Assisted in drafting various pleadings, preparing witnesses and digesting case files and work product received from the client's prior law firm. The trial team secured equally favorable results on appeal.
  • Is a member of the BakerHostetler team serving as court-appointed counsel to the Securities Investor Protection Act (SIPA) Trustee for the liquidation of Bernard L. Madoff Investment Securities LLC, working on international litigation in connection with one of the largest financial frauds in recorded history, and has been part of this team since the SIPA Trustee's appointment in December 2008, working on behalf of the SIPA Trustee on the complex investigations of individuals and entities allegedly tied to the Ponzi scheme. Is a lead associate on avoidance actions brought by the SIPA Trustee to recover funds for the benefit of defrauded investors, and in this capacity drafts pleadings, conducts depositions and other discovery, and participates in settlement negotiations with defendants.

Pro Bono

  • In a highly contested immigration matter, successfully prevented the deportation of a victim of persecution set to be involuntarily removed to his home country. Argued the case and headed the team that prepared evidentiary filings with the Immigration Court proving not only that the client had a well-founded fear of persecution, but that he was at great risk of suffering physical violence or death upon his return.
