Overview

Penny Cobey has concentrated her real estate practice in transactional construction law for more than 25 years. She is particularly adept in drafting and negotiating contracts between owners and design professionals, contractors, design-builders and other participants in complex construction projects. She has also advised public agencies, museums and other nonprofit institutions on the development and expansion of their facilities, as well as the commissioning of works of art.

Penny is a former Governing Committee member of the ABA Forum on Construction Law. She has lectured on design and construction issues to ABA Forum audiences across the United States, as well as to the American Institute of Architects, annual Build Boston expositions, public agencies, ALI-ABA programs and Yale University architectural students.

  • Represented the Toronto Blue Jays in the design and construction of a spring training player development complex, with associated stadium renovations, in Dunedin, Florida.
  • Led a legal team advising the City of Davis, California, in connection with the development of a $100 million design/build wastewater treatment facility.
  • Advised one of the largest international providers of food and beverage concessions to airports in connection with its responses to requests for proposals issued by an agency of the City of Los Angeles. Led the team defending a recommended contract award valued at more than $600 million before the Los Angeles City Council against bid protests.
  • Represented national condominium developer Crescent Heights in the design, construction and related contracts for 2020 Santa Monica Boulevard, an ultra-luxury condominium project in Los Angeles.
  • Served as senior construction counsel to the Los Angeles Unified School District in its $5 billion building program.
  • Advised the J. Paul Getty Trust in its ground-up renovation of the Getty Villa in Malibu, a reproduction of an ancient Roman villa in Herculaneum that now houses the Getty’s collection of antiquities.

Community

  • Bridges Academy (Los Angeles), Board of Trustees: Chair (2003 to 2006). Bridges is a school for “twice exceptional” students (gifted students dealing with learning challenges, such as dyslexia and emotional spectrum disorders). When Penny joined the board, Bridges was housed in a former suite of dental offices. Penny led the search for superior facilities, led the capital campaign and negotiated contracts for the acquisition and renovation of a former boarding school, leading to the first-class classrooms and spacious campus that Bridges enjoys today.
