Overview

Richard Bamberger has practiced in the employee benefits area since the passage of the Employee Retirement Income Security Act of 1974 (ERISA). With a calm demeanor, he handles employee benefits matters for taxable and nontaxable employers, including all aspects of retirement and welfare benefit plan matters. He has also been involved in collective bargaining situations regarding benefit plan matters, and has counseled closely held and publicly traded companies on structuring their employee benefits programs.

With developed sensitivity to issues employers are experiencing and an understanding of employer and employee dynamics and their respective wants and needs, Richard has been involved in structuring and maintaining employee benefits programs with respect to the Firm, its partners and employees.

  • Represents tax-exempt associations regarding tax-qualified pension and 401(k) plan designs, as well as their welfare benefit plans and executive compensation matters. Assists clients in navigating complex deferred compensation issues involving Internal Revenue Code and Department of Labor matters.
  • Performs transactional work for manufacturing clients in connection with multimillion-dollar acquisition matters. Responsible for all legal aspects in connection with the integration of retirement plan and welfare benefits post-acquisition.
  • Counsels clients regarding required post-acquisition corrections with respect to acquired retirement plans, which are undertaken through governmental post-acquisition voluntary correction procedure filings.
  • Assists closely held businesses in the design and structure of employee benefit programs. Assists owners and their employees in establishing mutually beneficial employee benefit plan programs.
