Federal Investigations

  • Defended U.S. multinational energy corporation in investigation by the Office of Inspector General (OIG) regarding sale and transportation of oil condensate. Resulted in closing of investigation with no monetary or penalty assessment.
  • Defended independent natural gas and oil producer in nationwide civil investigation by the Department of Justice (DOJ) under the False Claims Act for alleged underpaid federal royalties.
  • Defended counsel for wholesale power marketer in Federal Energy Regulatory Commission (FERC) investigation.

Royalty Payments and Audits

  • Represented independent oil producer in appeal of Order to Report issued by the Office of Natural Resources Revenue (ONRR). Appeal was granted, resulting in favorable decision.
  • Represented independent oil and gas company in appeal of decision issued by the North Dakota Field Office of the Bureau of Land Management (BLM) and concerning the flaring of natural gas.
  • Represented independent natural gas and oil producer in various appeals of ONRR-issued Orders to Report and Pay Additional Royalties.
  • Defended North American oil and natural gas exploration and production company in breach of contract suit concerning private royalty payments and deductions.
  • Represented independent oil producers and natural gas processors in ongoing audits by the ONRR.  
  • Represented oil and gas producers in the Denver Basin and the San Juan Basin in performing internal audits of private, federal, and Indian royalty payments and deductions.  
  • Represented national oil and gas trade association in reviewing and preparing comments to the ONRR's proposed amendments to civil penalty regulations affecting federal and Indian oil and gas leases (79 FR 28862). Author of public comment document.

  • Defended natural gas company in antitrust suit related to natural gas development from coal bed methane deposits in the Rocky Mountains. Resulted in favorable summary judgment.
  • Defended group of small family partnerships owning oil and gas rights in northwest Pennsylvania in breach of contract suit.
