Overview

Ben Barnes is a member of BakerHostetler's Information Governance team, working with clients to develop records retention schedules, document retention and deletion policies, and data maps. Additionally, he performs assessments for data privacy and security. He also applies his experience to help clients prepare for electronic discovery, develop electronic discovery plans and legal hold policies.

Ben is also a member of the BakerHostetler team serving as court-appointed counsel to the Securities Investor Protection Act (SIPA) Trustee for the liquidation of Bernard L. Madoff Investment Securities LLC (BLMIS), an unprecedented recovery effort involving hundreds of actions. Paying keen attention to detail, Ben works tirelessly to provide the best service possible.

  • Conducted data practice assessments and audits for a large technology company; reviewed their privacy policies, terms of use, vendor agreements and information security policies; helped design and implement comprehensive privacy, data protection and information governance programs.

  • Reviewed policies and practices related to information governance and information retention for a large energy and utility provider. Developed and information governance and updated the information retention schedule to meet the current compliance obligations and to match the industry best practice.

  • Performed an information governance assessment for a sales and marketing company to identify current information practices. Used the results of the assessment to develop an information governance policy and a legal hold policy to address the company’s specific concerns, litigation profile and industry-specific regulations.

  • Assisted a mortgage company in the evaluation of information-related practices. Developed information governance, record retention and legal hold policies to address concerns highlighted by the evaluation, compliance obligations and industry best practice.

  • Performed contract review for numerous enterprises during alleged data breach investigations to identify possible data obligations, including breach notification, security requirements, insurance requirements and indemnity provisions.

  • Working on cases in active discovery and document review to prepare evidence supporting the SIPA Trustee's claims against defendants, and working to respond to document requests from defendants.

  • Performed contract review for a retail corporation during a going-private transaction, researching possibilities for issues to be triggered as a result of the transaction.
