Overview

Possessing a depth of experience in intellectual property, Shannon McCue focuses his practice on patent and technology law. His background includes working with clients in the technology industry to formulate strategies for the procurement and protection of IP rights, including patents, trademarks, copyrights and trade secrets, as well as internal and external invention disclosure policies. An outgoing individual, Shannon enjoys communicating and working with clients to protect and develop new technology and business.

Active in the development and advancement of IP law, Shannon co-drafted Model Jury Instructions: Copyright, Trademark and Trade Dress Litigation and is a member of the Federal Rules Committee that drafted Patent Local Rules for the Northern District of Ohio

  • Represented a global welding equipment manufacturer in its U.S. patent prosecution matters, including arranging a demonstration of a virtual welding product at the U.S. Patent and Trademark Office to gain allowance of eight pending applications. During the demonstration, patent examiners (60 present and 120 via conference) were able to observe and operate the virtual welding simulator. 
  • Successfully defended an RFID manufacturer in a preliminary injunction hearing for patent infringement.

Experience

  • Represented a global welding equipment manufacturer in its U.S. patent prosecution matters, including arranging a demonstration of a virtual welding product at the U.S. Patent and Trademark Office to gain allowance of eight pending applications.   • Successfully defended an RFID manufacturer in a preliminary injunction hearing for patent infringement. 
  • Implemented a strategy to combat keyword advertising trademark infringement and domain name squatting for an identity theft protection company. Filed trademark infringement suits across the United States and negotiated to stop unauthorized keyword usage to drive down the price of the keywords associated with the client's trademarks. The keyword cost savings was estimated to be $10 million that year. 
  • Counseled a university on the steps needed to demonstrate a proper chain of title and register the copyright for a home movie of Sigmund Freud recorded in 1930.  
  • Managed trademark portfolios, including one with more than 4,000 filings worldwide.
  • Experienced with trademark clearance and enforcement.
  • Lead counsel for Trademark Trial and Appeal Board matters, including opposition and cancellation actions and appeals to the Federal Circuit.
  • Has developed trade dress and design patent strategies for manufacturing clients. Has enforced design patents in district courts.
