Overview

Sonja Inglin's broad-based environmental law practice includes state and federal court environmental litigation and related proceedings before administrative agencies. She regularly advises clients on issues involving environmental, health and safety requirements and compliance issues under state, federal and local laws, with a focus on requirements specific to California. Sonja is also experienced in addressing environmental issues arising out of the purchase and sale of businesses and real property and successor liability issues resulting from such transactions.

Environmental Litigation and Administrative Proceedings 

Sonja handles environmental litigation under the major federal and related state environmental laws, among them CERCLA and its California equivalent, the Hazardous Substances Account Act, the Clean Air Act and California air quality laws, and the Clean Water Act and the related California water quality statutes. She also handles environmental litigation involving contractual and state common law claims as well as defending toxic tort lawsuits brought under California's Proposition 65. Examples include: 

  • Prosecutes and defends CERCLA cost-recovery and other litigation related to Superfund sites, including regional groundwater, landfill and contaminated sediment sites. 
Environmental Counseling

Sonja regularly advises clients on environmental, health and safety issues under federal, state and local environmental laws, with a focus on California-specific laws and regulations (such as product warning requirements under California's Proposition 65 and California regulations governing the content of various products). Examples include:

  • Assists clients in addressing compliance with California and other state-specific requirements applicable to volatile organic compounds, formaldehyde and lead content of various products, including developing compliance programs, conducting product line audits, advising on self-reporting of violations and resolving civil penalty claims.
Real Estate and Corporate Transactions
  • Regularly carries out due diligence reviews related to environmental liabilities. Negotiates representations, warranties and indemnities associated with environmental liabilities. In turn, has litigated issues that arise under such contractual provisions and indemnities.

Environmental Litigation and Administrative Proceedings 

Sonja handles environmental litigation under the major federal and related state environmental laws, among them CERCLA and its California equivalent, the Hazardous Substances Account Act, the Clean Air Act and California air quality laws, and the Clean Water Act and the related California water quality statutes. She also handles environmental litigation involving contractual and state common law claims as well as defending toxic tort lawsuits brought under California's Proposition 65. Examples include: 

  • Prosecutes and defends CERCLA cost-recovery and other litigation related to Superfund sites, including regional groundwater, landfill and contaminated sediment sites. 
  • Defends toxic tort lawsuits alleging personal injury and property damage claims associated with releases of chemicals to the air and groundwater and alleging workplace exposure to chemicals. 
  • Defends Proposition 65 lawsuits alleging failure to warn of exposure to lead, DEHP and other chemicals in a variety of industrial, food, household and consumer products.
  • Represents clients in response to CERCLA unilateral administrative orders, including development of sufficient cause defenses and responding to stipulated penalty claims.
  • Represented clients in a citizen's suit under Clean Water Act alleging discharge violations. 
  • Represents clients in a range of civil penalty actions alleging violations of air quality and water quality statutes. 
  • Represents clients in conducting site investigations, including addressing access issues, negotiating the scope of required work site closure conditions and implementing post-closure deed restrictions and other administrative controls.  
Environmental Counseling

Sonja regularly advises clients on environmental, health and safety issues under federal, state and local environmental laws, with a focus on California-specific laws and regulations (such as product warning requirements under California's Proposition 65 and California regulations governing the content of various products). Examples include:

  • Assists clients in addressing compliance with California and other state-specific requirements applicable to volatile organic compounds, formaldehyde and lead content of various products, including developing compliance programs, conducting product line audits, advising on self-reporting of violations and resolving civil penalty claims.
  • Advises manufacturers, distributors and retailers on Proposition 65 compliance issues, including advising on product testing and exposure assessments, implementing Proposition 65 labeling programs, analyzing occupational warning requirements and addressing supply chain issues and customer certification requests.  
  • Counsels clients on compliance with regulations governing transportation of hazardous materials and related packing and training requirements. 
  • Represents clients in addressing (and responding to notices of violations related to) characterization, management and disposal of hazardous waste and related employee training requirements.  

Real Estate and Corporate Transactions

  • Regularly carries out due diligence reviews related to environmental liabilities. Negotiates representations, warranties and indemnities associated with environmental liabilities. In turn, has litigated issues that arise under such contractual provisions and indemnities.
  • Work on due diligence involves negotiating consulting agreements with environmental consultants, including provisions related to insurance, indemnity and confidentiality. Also advises clients on state law property transfer disclosure laws and post-disposition closure requirements.
