As of September 27, 2021, the 2004 and 2010 versions of the European Union’s Standard Contractual Clauses (SCCs) will officially be retired. Businesses seeking to use SCCs to cover new transfers of EU personal data will need to implement the updated SCCs released by the EU Commission in June. Also, companies with existing contracts that rely on the outdated SCCs will need to transition to the new SCCs before the end of 2022.
Although the new SCCs address certain practical issues associated with the old versions, they also introduce more burdensome compliance obligations on businesses.
