Partner Carl Hittinger and Associate Jeanne-Michele Mariani authored an article published Sept. 9, 2019, by The Legal Intelligencer. The article, “Does Section 2 of the Sherman Antitrust Act Need More Bite?” discusses proposed legislation that would allow massive civil fines to be levied against companies found to have engaged in monopolization offenses under U.S. antitrust law. Hittinger and Mariani review the history of the Sherman Act and its enforcement and the argument that today’s mega companies may not be deterred by the current statutory fines.
