Partner Carl Hittinger and Associate Tyson Herrold authored an article published Dec. 1, 2017, by The Legal Intelligencer. The article, “New Antitrust Division Chief Prioritizes Regulation of Standard Setting Organizations,” discusses the efforts of Makan Delrahim, head of Department of Justice Antitrust Division, to prioritize federal and state review of standard setting organizations (SSOs). Delrahim believes that SSOs should be more rigorously scrutinized, especially when it comes to IP licensing and the potential for anticompetitive activity.
Hittinger and Herrold conclude: “SSOs and their members should take to heart and view Delrahim’s comments as presenting an opportunity to engage in a probably long overdue review and update of their antitrust policies and to re-evaluate their training protocol.”
