Carl Hittinger, Tyson Herrold Review Antitrust Opinions of Nominee Neil Gorsuch

Partner Carl Hittinger and Associate Tyson Herrold authored an article published Feb. 6, 2017, by The Legal Intelligencer. The article, “The Antitrust Points of View of Supreme Court Nominee Neil Gorsuch,” reviews three antitrust opinions authored by Judge Neil Gorsuch, who is President Trump’s nominee to fill the seat on the U.S. Supreme Court left vacant in 2016 after the death of Justice Antonin Scalia. Hittinger and Herrold conclude that although Gorsuch has more antitrust experience than Scalia, he holds antitrust views similar to those of Scalia, “ostensibly applying the Sherman Act to avoid replacing procompetitive, free-market behavior with judicially imposed, anti-competitive fiat.”
