Charlie Lyu Article Examines Debate over Applications for Racist Trademarks

Associate Charlie Lyu authored an article published in the Fall 2016 issue of the “Embracing Diversity Newsletter” published by the ort Trial & Insurance Practice Section of the American Bar Association. Lyu’s article, “Offensive Trademarks on the Horizon?” examines the debate over whether the disparagement provision of Section 2(a) of the Lanham Act is a violation of the First Amendment. The disparagement provision has been cited by the Patent and Trademark Office (PTO) as the reason for refusing trademarks to hateful and racist terms.
