Cole, Forman, Mosier Provide Companies with Compliance Takeaways to Address Mid-Investigation Tips to the SEC

Partner Tracy Cole, Co-Chair of BakerHostetler’s Whistleblower and Compliance practice group, along with Associates Jonathan Forman and Mackenna Mosier authored an article published in the June 2016 issue of NSCP Currents, a professional journal published by the National Society of Compliance Professionals.  The article, “It’s Not Over Until the Last Whistle Blows:  Beware of the Mid-Investigation Tip,” analyzes the Securities and Exchange Commission’s first publicized whistleblower award in the amount of $3.5 million for a tip provided during an investigation that “significantly contributed” to the success of the resulting enforcement action.  In light of this development and the increasing frequency of whistleblower awards issued by the SEC, Cole, Forman, and Mosier provide compliance takeaways to companies to address the significant financial incentives presented to potential whistleblowers by the SEC’s Whistleblower Program.
