Daniel Buzzetta Article Examines New York Ruling on Common Interest Doctrine

Partner Daniel Buzzetta authored an article published July 11, 2016, in the New York Law Journal. The article, “Merger Partners: Beware of Effect of Ambac Ruling on Privilege,” examines a June ruling by the New York Court of Appeals in Ambac Assurance Corp. v. Countrywide Home Loans that a threat of litigation is necessary before a part may share attorney-client privileged information with another party with whom it shares a common interest. Buzzetta outlines the issues involved and notes that parties who share a concern about discoverable communications “should consider jointly retaining a single law firm to serve as special counsel to address such issues.” Associate Bari Nadworny assisted in the preparation of the article.
