Partner Deborah Wilcox reports on the Trademark Trial and Appeal Board (TTAB) decision to affirm the refusal to trademark ALDECOA on the ground that it is primarily a surname. Wilcox writes that although it is a rare surname, the TTAB gave particular weight to the fact that “de ALDECOA” is the surname of the founder of the applicant as well as the applicant’s current generation of coffee brewers.

The article “Rare Surname Refused Registration” appeared in the Dec. 15, 2016, issue of the INTA Bulletin, published by the International Trademark Association.
