Deborah Wilcox Reviews TTAB Decision Regarding Custard Specimen

Partner Deborah Wilcox writes about the decision of the Trademark Trial and Appeal Board (TTAB) to affirm the rejection of a small sign submitted as a specimen for a seller of frozen custards on Coney Island. The TTAB agreed with the examining attorney that the specimen was too small, vague and ineffectual to meet the required standard.
