Partner Deborah Wilcox reviews the decision of the U.S. Trademark Trial and Appeal Board (TTAB) in the matter of In re Adlon Brand GmbH & Co. KG c/o FUNDUS FONDS-Verwaltungen GmbH, in which the board reaffirmed the rule that “even a rare surname is unregistrable if its primary significance to purchasers is a surname.” The article, “ADLON: Surely a Surname?” appeared in the Feb. 1, 2017, issue of the INTA Bulletin, published by the International Trademark Association.
